An interdisciplinary conference co-sponsored by the Center for Iberian and Latin American Studies at University of California, San Diego and the Center for Creative Problem Solving at California Western School of Law. Many Latin American countries are accepting the premise that traditional legal systems have a rightful place within the modern state. The two systems, however, are highly divergent, and significant work is still to be done to create a functional pluralistic system that respects indigenous peoples’ right of self-determination, international human rights obligations, and institutionalizes a means of adjudicating outcomes when indigenous and national legal systems clash. This conference will discuss those challenges for Latin America, drawing on the experiences of Canada and the U.S. |
